Wedding Terms and Conditions
The following terms and conditions apply to wedding photography undertaken by Andrew Gransden Photography.
A non-refundable booking fee of £300 is payable on booking to secure the time and services of Andrew Gransden, the photographer. The outstanding fee is payable in full 2 months before the wedding.
All reorders shall be treated as an extension of this contract and no responsibility for errors will be accepted unless orders are given in writing.
The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The photographer’s judgement regarding the locations/poses and number of images taken shall be deemed correct. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Only those images that pass editing and are deemed by the Photographer to have reached a high and professional standard will be shown and made available. All image sizes are nominal. The Photographer will provide a pleasing colour balance but no guarantee of exact colour matching can be given owing to nature of the reproduction process. It is sometimes impossible to record the exact colour as seen by the human eye. Retouching, digital manipulation and artist finishing will be employed to give the best results possible.
Force Majeure or Act of God
The due performance of the contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
In the unlikely event of the Photographer being unable to attend your wedding due to unforeseen circumstances, he reserves the right to appoint another photographer to attend your wedding on his behalf to undertake the wedding photography to his/her best ability.
It is a condition of booking that Andrew Gransden Photography is the only professional photographer working at the wedding and no other vendor is allowed to take photographs which are offered for sale. If the situation arises where this is not the case, the photographer reserves the right to cease photography and all monies paid will not be refunded. This does not apply to videographers engaged but we must to be advised so that our coverage can be coordinated.
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instructions, although every effort is made to comply with the client’s wishes. Any special requests not notified on the booking form must be made by the client to the photographer in writing.
Meals, Accommodation and Travel Costs
The client is required to arrange a hot meal for the photographer(s) where coverage extends over the meal. For weddings over 150 miles/2.5 hours drive from Buckie, Moray, the photographer reserves the right to charge for overnight accommodation and fuel costs. This is to ensure that your photographer is in the best condition for your day.
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
The Client may cancel the contract at any time by giving written notice but in doing so shall forfeit any monies paid. Should cancellation be received less than 12 weeks prior to the wedding, the Client shall in addition pay a sum equal to 50% of the contract value. The sum shall be payable as compensation as an estimate of the loss suffered by the Photographer.
The Photographer will own the copyright on all images in all forms whether stored digitally or printed and remain the property of the Photographer. No copies of any kind (photographically/ electronically or by other means) may be made or be allowed to be made without the express written permission of the photographer.
Use of Images
The Client(s) hereby allow the Photographer to display any of the images included in this contract in the studio, portfolios, literature, wedding, display areas, exhibitions, publicity, marketing, advertising, competitions or slide shows. No use of the images will be made by the Photographer for other commercial reason except with the written permission of the client.
Any complaints should first be raised by the Client by writing to the Photographer within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of the date of receipt of the images. In the unlikely event of an unresolved compliant the Client may request the Master Photographers Association or Society of Wedding and Portrait Photographers to mediate but only on the basis that their decision shall be final and binding upon both parties.
